These Terms and Conditions (“Terms”) govern your use of the website and the purchase of any artworks, prints, or products (collectively, “Products”) from Jamie Kay Art.

By accessing the site or purchasing a Product, you agree to be bound by these Terms.

1. Intellectual Property

All content included on this site, such as text, graphics, logos, images, and digital downloads, is the property of Jamie Kay Art and is protected by Canadian and international copyright laws.

• No Reproduction: The purchase of a physical Product (original art or print) does not transfer any copyright or reproduction rights to the buyer. You may not scan, duplicate, or distribute copies of the artwork for commercial or personal use without express written permission.

2. Product Information and Pricing

• Accuracy: Every effort is made to display the colors and textures of the artwork accurately. However, as screen calibrations vary, the colors you see may differ slightly from the physical Product.

• Pricing: All prices are listed in Canadian Dollars (CAD) unless otherwise stated. Prices are subject to change without notice.

• Taxes: For customers in Ontario and across Canada, appropriate HST/GST will be applied at checkout based on provincial requirements.

3. Orders and Payment

• Contract: Your receipt of an order confirmation does not signify acceptance of your order. Jamie Kay Art reserves the right to accept or decline your order for any reason, including product availability or errors in pricing.

• Payment: Payments are processed securely. You represent that you have the legal right to use any payment method provided.

4. Shipping and Delivery

• Shipping Rates: Shipping costs are calculated at checkout based on the destination and dimensions of the artwork.

• Risk of Loss: All items purchased are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

• International Orders: Customers outside of Canada are responsible for any customs duties, taxes, or import fees levied by their destination country.

5. Returns and Refunds

• Sales Policy: Due to the unique nature of original artwork and made-to-order prints, all sales are final / returns are accepted within 30 days].

• Damaged Goods: If a Product arrives damaged, please contact hello@jamiekayart.com within 48 hours of delivery with photographic evidence of the damage and the packaging to initiate a claim or replacement.

6. Limitation of Liability

To the maximum extent permitted by the laws of Ontario, Jamie Kay Art shall not be liable for any indirect, incidental, or consequential damages resulting from the use of the website or the purchase of Products. Our total liability to you for any claim arising out of these Terms shall not exceed the amount paid by you for the Product in question.

7. Consumer Protection

Nothing in these Terms is intended to vary or exclude any right or remedy that you may have under the Ontario Consumer Protection Act or other applicable consumer protection legislation.

8. Governing Law

These Terms and any disputes arising out of your use of the site or purchase of Products are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. You agree to submit to the exclusive jurisdiction of the courts located in Ontario.

9. Changes to Terms

These Terms may be updated periodically to reflect changes in business practices or legal requirements. Continued use of the site after such changes constitutes acceptance of the new Terms.
